Why Language Matters in Family Law
Family law involves some of the most personal and consequential decisions you will ever face, including decisions about your children, your home, your finances, and your future. To make informed decisions, you need to fully understand your legal rights, your obligations, and the options available to you.
When those conversations happen in a second language, important details can be missed or misunderstood. Legal concepts that are straightforward in Farsi may not translate clearly in English. The emotional weight of a difficult conversation is harder to carry when you are simultaneously translating.
Being able to speak with your lawyer in Farsi means you can describe your situation fully, ask the questions you actually have, and understand the answers without uncertainty. It means nothing gets lost between what you say and what your lawyer hears.

Family Law Services for Persian and Farsi-Speaking Clients
Bani Family Law helps Persian and Iranian clients throughout Markham, Richmond Hill, and the GTA with a full range of family law matters, including:
Divorce and Separation
Whether you are considering separation for the first time or are already in the process, we help you understand how Ontario divorce law works, what your rights are, and what steps to take. We assist with both uncontested and contested matters and help clients reach fair, comprehensive separation agreements that address parenting, support, and property clearly.
Child Support
Both parents have a legal obligation to financially support their children after separation. We help clients understand how child support is calculated under the Federal Child Support Guidelines, how special and extraordinary expenses are handled, and what options are available when income is disputed or circumstances change.
Spousal Support
Depending on the length of the marriage, the roles each spouse played during the relationship, and the financial circumstances of both parties, one spouse may be entitled to support from the other after separation. We help clients assess entitlement, negotiate support arrangements, and address variations when circumstances change.
Parenting Time and Decision-Making Responsibility
Parenting arrangements are often the most emotionally significant part of a family law matter. We help clients develop parenting plans that reflect the best interests of their children, and provide strong representation in high-conflict parenting disputes when court involvement becomes necessary.
Property Division and the Matrimonial Home
In Ontario, spouses are generally entitled to share equally in the net growth of property accumulated during the marriage, a process called equalization. The matrimonial home is subject to special rules regardless of whose name is on title. We help clients understand their property rights and work toward fair resolutions.
Marriage Contracts and Cohabitation Agreements
A marriage contract or cohabitation agreement can provide important financial protections and clarity about each party’s rights and obligations. We draft these agreements carefully to ensure they are legally sound, clearly written, and tailored to your specific circumstances and goals.
Collaborative Family Law
Collaborative family law is a structured process in which both spouses and their lawyers work together to reach a resolution without going to court. It is often faster, less adversarial, and less costly than litigation. Shelly Banihashemi is a certified collaborative lawyer and is experienced in guiding clients through this process.
Understanding Ontario Family Law as a Member of the Persian Community
The Ontario family law system operates differently from the legal systems in Iran and many other countries. Understanding those differences is important for anyone navigating separation or divorce in Ontario for the first time.
Marriage Recognition
Marriages that took place in Iran or other countries are generally recognized in Ontario, provided they were valid under the laws of the country where they occurred. This includes both civil and religious marriages. We can help you understand how your marriage is treated under Ontario law and what rights and obligations flow from it.
Mahr and Religious Agreements
Mahr is a common provision in Islamic marriage contracts. Whether and how a mahr obligation is enforceable under Ontario law depends on the specific circumstances, including how the agreement was structured and whether it meets the requirements of a valid domestic contract under the Family Law Act. We help clients understand their rights in relation to mahr and other religious or pre-marital agreements.
Property Rights for Common-Law Couples
In Ontario, common-law spouses do not have the same automatic property rights as married spouses. This is an important distinction for couples who have lived together without marrying. We help clients understand what rights they have and what legal options are available to them on separation.

What to Expect at Your First Consultation
Your first consultation is an opportunity for us to understand your situation and for you to understand your legal options. We use this time to:
- Listen carefully to your family law matter and your immediate concerns
- Explain your legal rights and options clearly, in Farsi if you prefer
- Identify the most important next steps based on your circumstances
- Answer your questions so you leave with more clarity and confidence
- Discuss a practical strategy for moving your matter forward
You do not need to have documents prepared or decisions made before your first meeting. Many clients come to us at the very beginning of their separation, unsure of what the process involves or what their rights are. We will help you make sense of where things stand.

Frequently Asked Questions
Can I speak with my lawyer in Farsi?
Yes. Shelly Banihashemi is a fluent Farsi speaker and is happy to conduct consultations and ongoing communication in Farsi for clients who prefer it. You do not need to navigate this process in English if Farsi is more comfortable for you.
Is my marriage from Iran recognized in Ontario?
Marriages that took place in Iran are generally recognized in Ontario if they were valid under Iranian law at the time they occurred. This includes both civil and religious marriages. We can help you confirm how your marriage is treated and what legal rights flow from it.
Is my mahr enforceable in Ontario?
Whether a mahr is enforceable under Ontario law depends on the specific circumstances, including how the agreement was structured and whether it meets the requirements of a valid domestic contract. This is something we can assess during a consultation.
What family law services does Bani Family Law offer?
We help clients with the full range of family law matters, including divorce and separation, child support, spousal support, parenting arrangements, property division, separation agreements, marriage contracts, cohabitation agreements, restraining orders, collaborative family law, and court proceedings.
Do I need a lawyer if my spouse and I agree on everything?
Independent legal advice is strongly recommended before signing any separation agreement, even when both parties are in agreement. A lawyer can ensure the agreement is fair, legally sound, and that you fully understand your rights before committing to its terms.
